Probate Fees

Probate is the process of dealing with the estate of someone who has died – which generally means clearing their debts and distributing their assets in accordance with their will. The term ‘probate’ refers to the obtaining of permission to deal with the estate. Depending on whether or not there is a

Will involved in the estate and depending on the value of the estate, those in charge of the administration will need to apply to the court for a ‘grant of probate’ or a ‘grant of letters of administration’.

‘Grant Only’ Service

Choosing our ‘Grant Only’ Service means that we will apply to court for the necessary grant for you, completing and submitting the required forms.
Our fees for applying for the Grant on your behalf are £450 plus VAT and disbursements.

The exact cost will depend on the individual circumstances of the matter. This quote is for estates where:

– There is a valid Will
– There is no more than one property
– There are no other intangible assets
– There are no disputes between the beneficiaries and no claims against the estate
– There is no inheritance tax payable and the Executors do not need to submit a full account to HMRC

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of disbursements on your behalf to ensure a smoother process. With the ‘grant only’ service the disbursement payable is the court fee which is £155 at the time of writing, and 50p per office copy.

This service is designed for executors and administrators who have the time to deal with administering the assets in an estate themselves. For example, if there are a limited number of assets involved.

We will:

– Provide you with a dedicated and experienced probate solicitor to work on your matter
– Identify the legally appointed executors or administrators and beneficiaries
– Accurately identify the type of Probate application you will require
– Obtain the relevant documents required to make the application
– Complete the Probate Application and the relevant HMRC forms
– Draft a legal oath for you to swear
– Make the application to the Probate Court on your behalf
– Obtain the Probate

Full Estate Administration Service

This service includes start to finish administration of the estate and includes:

– Providing you with a dedicated and experienced probate solicitor to work on your matter
– Gathering the relevant information about the number and type of assets and liabilities in the estate
– Identifying the legally appointed executors or administrators and beneficiaries
– Accurately identify the type of Probate application you will require
– Ascertaining the correct valuations of assets and debts in the estate for inheritance tax purposes
– Advising on terms of the Will
– Dealing with HMRC, DWP, Utility Companies, Asset holding institutions
– Obtaining the relevant documents required to make the application
– Completing the Probate Application and the relevant HMRC forms
– Drafting a legal oath for you to swear
– Making the application to the Probate Court on your behalf
– Obtaining the Probate/ Letters of Administration
– Administering the estate once the Grant has been obtained, collecting assets and discharging liabilities
– Preparing estate accounts and distributing the estate

The cost of our full administration service will be based entirely on the individual circumstances on the case and our costs are calculated on a time spent basis with the hourly rates being dependent on the Solicitor dealing with your matter. Our work is charged at an hourly rate. Hourly rates depend upon the level of fee-earner as follows:

– Partners, Solicitors and Legal Executives with over 8 years’ experience £200 plus VAT
– Solicitors and Legal Executives with over 4 years’ experience £175 plus VAT
– Other Solicitors and Litigation Executives £140 plus VAT
– Trainee Solicitors and Paralegals £100 plus VAT.
